Outbound Compliance Guidelines

Your responsibilities when sending outbound messages through the Texterz platform.

These guidelines are incorporated by reference into the Terms of Service (Section 6.3). Violation may result in account suspension.

1.Your Responsibility

Texterz is an infrastructure provider. We provide the tools to send messages across channels. You are solely responsible for:

  • The content of all messages sent through the platform
  • The selection of recipients and the legal basis for contacting them
  • Obtaining and maintaining documented, explicit consent (or other lawful basis) before outbound communications
  • Compliance with all applicable laws and third-party platform policies

We do not review, approve, or monitor individual campaigns or messages.

2.Channel-Specific Rules

WhatsApp (Meta Business API)

  • All outbound messages must use approved message templates (HSMs) outside the 24-hour customer service window
  • Customers must comply with Meta's WhatsApp Business Policy and Commerce Policy
  • Opt-out requests must be honored immediately
  • Bulk unsolicited messaging is prohibited by Meta and will result in account suspension

Telegram (Bot API)

  • Bots may only message users who have initiated contact first (started the bot)
  • Broadcast messages to users who have not interacted are prohibited by Telegram
  • Comply with Telegram's Terms of Service for bot operators

Email

  • All outbound email must comply with CAN-SPAM (US), CASL (Canada), and GDPR (EU) as applicable
  • Every email must include a working unsubscribe mechanism
  • Purchased or scraped email lists are prohibited
  • Honor unsubscribe requests within the legally required timeframe

SMS

  • Prior express consent is required for all SMS communications (TCPA, GDPR)
  • A2P (Application-to-Person) registration is required in most jurisdictions
  • Opt-out via STOP keyword must be supported

Voice

  • AI voice calls must disclose that the caller is an AI system at the start of every call
  • Do-not-call lists must be respected
  • Recording and transcription requires consent where legally required

3.Consequences of Violations

  • Third-party providers (Meta, Telegram, email providers) may suspend or ban your account without notice
  • Texterz assumes no liability for account bans, enforcement actions, fines, or penalties resulting from your messaging practices
  • No refunds are issued for subscriptions or credits lost due to provider bans caused by your use
  • Texterz reserves the right to suspend your account if your messaging practices threaten platform integrity or reputation

4.Disclaimer

Texterz provides communication infrastructure. Using Texterz alone does not ensure compliance with any law or platform policy. You are solely responsible for ensuring that your outbound communications comply with all applicable regulations.
